Apple, AT&T getting sued over poor iPhone 3G performance, again

We now have the second lawsuit regarding the iPhone 3G, this time its being brought by William Gillis who is taking on not only Apple but also AT&T. Gillis is claiming that both Apple and AT&T are to blame and that the iPhone 3G requires too much power on the network. That combined with the “high volume” that have been sold have taken their toll on the AT&T network and in turn given customers a poor experience. In short he is accusing Apple and AT&T of knowingly overselling the iPhone 3G.

Gillis is currently seeking class action status so every California AT&T customer can also have their chance to be compensated. He is hoping that the lawsuit will eventually make Apple and AT&T pay restitution and punitive damages for those that have “suffered through a sub-par 3G experience.” But perhaps more important he is also looking to have both companies change their marketing material.

Bottom line is that Gillis is looking to have Apple and AT&T “simply disclose complete and accurate information about the product.”

    AT&T is definately to blame here more than Apple, I believe. Looking at the results on what I believe is the same hardware, other providers around the world can be faster. I also hit lots of dead spots and EDGE-only spots - and right there it shows me that AT&T’s coverage in general is crap (which I already knew)

    AT&T has a monopoly on the hottest phone out there. They’re guaranteed business now for two years from everyone with an iPhone basically. Let’s beef our network up now please. Before everyone else rolls out 4G/Wimax and I switch out of disgust :P

    (Man, iPhone + Wimax would be dope!)
