Remember those iPhone 3G’s that were beginning to crack shortly after the initial release? Well it turns out that, thanks to Long Island resident Avi Koschitzki, a class action lawsuit has been filed in a Nassau County courthouse.
The suit that is being brought forth by Koschitzki covers those cracks that many were experiencing. In the suit, he is claiming that “Apple was and is aware that the iPhones were and are defective,” and that they have “allowed the defectively designed iPhones to be sold to the public.”
Of course, the issue with the cracks was not the entire basis of the suit. Koschitzki is also including a few other (now standard) issues, such as poor 3G reception and speeds, as well as third-party application crashes and the fact that he is “unhappy with the handful of iPhone Software updates released to date.”

What an idiot. Has anyone with that crack tried returning their phone to an Apple store? Usually they will gladly give you another one. and the poor reception and speeds are not Apple’s fault, and AT&T offers a 30 day return policy on all of their cell phones. What 3rd party application crashes - and what does that have to do with Apple? And being unhappy with software updates released to date - I don’t think Apple is obligated to release any software updates, are they?

I agree with Larry, he is an idiot. There are always defects is anything. Return the phone, get a new phone, contact AT&T regarding your “poor reception” and I believe the other issues are just nonsense. Just another person trying to get money, how disgraceful!

Apple is notorious for selling defective products, then denying they are defective and giving their “geniuses” scripted lines to place the blame on the consumer. I was a victim of the first generation ipod battery defect (that took a class action lawsuit to get apple to admit fault). My roommate fell prey to the macbook “random shutdown syndrome” debacle and had to . Now my iphone screen just cracked from a one foot drop that wouldn’t have scratched any other phone on the market. The customer care person did not “gladly give me another one.” He insisted it was my fault, even though it’s pretty obvious from the large number of internet testimonials that this is a widespread problem and a manufacturers defect. I guess the joke is on me for trusting apple again.
It’s not the defects that anger me. Of course not every product is going to work perfectly. What’s disgusting is the lengths Apple goes to deny these defects and screw their customers. Sue ‘em Avi. They deserve it.

One thing is sure that the 3 first idiots above are those people you get scrued and the even say thank you and where can we get more.
The guy has b.lls enough to take apple to court, and you will see he will get a new iphone and some writhen excusses from apple, as the other 3 geniuses will still be with there perfect iphone.

Sometimes the Apple Store refuses to replace the phone because the “Genius” says “I’ve never seen this issue before”. As was my case. After I printed a 49 page thread off of MacRumors and showed it to them, they said that it only happens to White iPhones, when some of the posts directly contradict that. If I wasn’t a minor, I would be taking part in this lawsuit, because I now have a $300 phone that has two cracks in it.

Every one of you that is whining about Apple needs to get real. Don, you are a baby and know nothing. It is obvious that you are a minor because you are acting like a child. Take better care of your things and stop trying to blame the manufacturer for your mistakes. Brad, you are even more of a moron than Don is and know absolutely nothing about Apple. You dropped your phone and it cracked. That doesn’t sound unusual at all andi s exactly what happens when you drop things that are made of glass. Maybe next time you will be more careful with your stuff or just stop buying expensive products all together if you are going to break them and then cry about it. Both of you are bitches. And as for this lawsuit, it will not hold up and anyone who thinks it will has no concept of reality. If I could smack all of you in the face right now I would.

The lawsuite may be dumb but sometimes it is necessary for a large corporation to admit fault. Coming from Apple, they probably deserve it. I mean, look at their CEO.
